Welcome to Imgica AI, an AI powered platform offering image generation, video creation, audio tools, model training, and API access (collectively, the "Service"). These Terms and Conditions ("Terms") govern your use of the Service and form a binding legal agreement between you and Imgica AI (referred to as "Imgica AI," "we," "us," or "our").
By creating an account or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
If you are using the Service on behalf of an organization or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" as used in these Terms includes both you as an individual and that entity.
You must be at least 13 years old (or the minimum digital age of consent in your country, if higher) to use Imgica AI. If you are under 18 (or under the age of majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
To access most features, you must create an Imgica AI account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Each user may register and use only one account, and you may not share your account with others. You must not misrepresent your identity or affiliation with any person or entity.
Imgica AI offers both free access (with limited features or usage quotas) and paid plans that provide enhanced features, higher usage limits, or access to premium tools. The Service uses a token system for consumption of resources.
All paid plans are one time, prepaid purchases for a fixed term: thirty (30) days for monthly plans and three hundred sixty five (365) days for yearly plans. You must provide a valid payment method at the time of purchase, and the full fee for the selected term is charged once, in advance.
There is no automatic renewal and no recurring billing of any kind. We do not charge automatic payments. Your access to paid features ends at the end of the paid term unless you manually renew by purchasing a new plan before or after your current term expires.
We may adjust the pricing and/or features of paid plans and will provide advance notice of any material changes. Any pricing change applies only to purchases made after the change takes effect and does not affect a term you have already paid for.
Plan fees and purchased token packs are non refundable once the tokens have been used. If the tokens from a purchase are still unused, the purchase may be refunded within 24 hours of buying, as described in our Refund Policy. Other refunds are provided only as required by law.
Imgica AI provides a Model Context Protocol server (the "MCP Server") and personal API keys so that AI assistants, agents and your own software ("Connected Apps") can use the Service on your behalf. Use of the MCP Server and API keys is part of the Service and is governed by these Terms, including the Acceptable Use and NSFW policies, whether a request comes from you directly or from a Connected App.
Your account, your responsibility. A Connected App acts as you. Work it creates is charged to your token balance at the same rates as the studio, and content it generates is treated as content you created. You are responsible for everything done through your keys and connections, including by any software or automation you run.
Keys and connections are personal. API keys are issued to your account and must not be shared, published, sold, or used to give other people or businesses access to the Service. You must keep keys confidential and revoke any key you believe has been exposed. You may disconnect a Connected App or revoke a key at any time from Studio settings.
Fair use and limits. Rate limits and the concurrent job limits of your plan apply to Connected Apps. We may throttle, suspend, or revoke keys and connections that place unreasonable load on the Service, circumvent limits or content moderation, or otherwise violate these Terms.
Third party assistants. The assistant or platform you connect (for example ChatGPT or Claude) is provided by its operator under separate terms. We are not responsible for how that operator handles your data or presents our Service, and the availability of the MCP Server inside a third party product may change without notice.
Charges and refunds. A job started by a Connected App is charged when it is submitted, and the tokens are returned automatically if the job fails. Plan fees and token packs remain subject to Section 3 and our Refund Policy.
Changes. The MCP Server, its tools, and the API are part of an evolving Service and may be changed, limited, or withdrawn as described in Section 4.
Imgica AI is continually evolving. We are constantly improving and updating the Service's features and capabilities. You acknowledge that the Service may change over time as we refine our products.
We reserve the right to add, modify, or remove features or functionality of the Service at any time, with or without notice, provided that if you are a paid subscriber and a change materially reduces core functionality of your plan, we will endeavor to provide you notice or an adjustment.
We strive to maintain the Service's availability but do not guarantee uninterrupted, error free operation or any specific uptime. The Service may occasionally be unavailable for maintenance, updates, or network issues.
By using Imgica AI, you agree to use the Service only for lawful purposes and in compliance with these Terms and all applicable laws and regulations. You agree not to:
ZERO TOLERANCE NSFW POLICY: See Section 5A for Full Details
Imgica AI enforces a strict, zero tolerance policy against all forms of NSFW, adult, sexually explicit, or pornographic content. Any violation will result in immediate, permanent account termination without warning, with all paid tokens and plans forfeited and non refundable. Violations may also be reported to the appropriate authorities.
Violation of this Acceptable Use Policy may result in suspension or termination of your account, removal of content, and/or other legal action where appropriate.
ZERO TOLERANCE POLICY: NSFW CONTENT IS STRICTLY PROHIBITED
Imgica AI is an image and video generation platform intended exclusively for lawful, family safe, and professional creative use. The generation, uploading, sharing, or distribution of any Not Safe For Work (NSFW) content is absolutely prohibited under all circumstances. This is a non negotiable, platform wide policy with no exceptions.
For the purposes of this Policy, "NSFW Content" and prohibited material includes, but is not limited to:
Imgica AI employs automated content moderation systems, AI based classifiers, and human review processes to detect prohibited content. Our systems operate continuously and flag suspicious prompts, inputs, and outputs. Attempts to bypass, jailbreak, or circumvent these filters are themselves a violation of this policy and will trigger immediate enforcement action.
We reserve the right to review any content generated through the Service and to take enforcement action at our sole discretion. No prior warning is required before enforcement is applied.
Users found in violation of this NSFW Policy are subject to the following enforcement actions, applied immediately and without prior notice:
Claiming that prohibited content was generated "accidentally," "for artistic purposes," "for research," or "as a test" does not exempt you from enforcement under this Policy. All determinations are made at the sole discretion of Imgica AI's moderation team, and our decisions are final.
If you encounter NSFW content generated by another user or discover a potential bypass of our filters, please report it immediately to support@imgica.com. Good faith reports are taken seriously, investigated promptly, and treated confidentially.
Summary: Imgica AI is a safe, professional platform. We do not tolerate NSFW content of any kind. Violations result in immediate permanent bans, forfeiture of all paid tokens, and potential legal action. By using our Service, you explicitly acknowledge and agree to this Zero Tolerance NSFW Policy.
